1. contracting parties
For all purchase contracts concluded via the online shop www.zerresstore.com, the following terms and conditions shall apply between the seller, Zerres Retail GmbH & Co. KG, Regioparkring 1, 41199 Mönchengladbach, (hereinafter also referred to as „we“) and the Buyer (hereinafter also referred to as „you“) the following General Terms and Conditions of Business.

2. Conclusion of Contract
The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. By clicking on the button [complete purchase] you are making a binding offer to purchase. Confirmation of receipt of the order is sent by automated e-mail immediately after the order is sent and does not constitute acceptance of the contract on our part.
We can accept your order by sending a separate order confirmation by e-mail or by delivering the goods within 5 working days within Germany, within 10 working days to Belgium, Austria and the Netherlands or within 11 working days to Luxembourg. No contract of sale shall be concluded for goods from an order which are not listed in the order confirmation. Your contractual partner is Zerres Retail GmbH & Co. KG.

3. Delivery / Shipping Costs
For the time being, the Zerres Store Online Shop delivers free of shipping costs within Germany via DHL, as long as stocks last. Shipping to other European countries is also carried out by DHL. There are flat-rate costs of 5 &euros.  The delivery time for shipping within Germany is 2 to 5 working days, for shipping to Belgium, Austria and the Netherlands 3 to 10 working days and to Luxembourg 3 to 11 working days. to Luxembourg 3 to 11 working days after receipt of the complete and error-free order.
Only persons of legal age with a residential address in Germany, Austria, Belgium or the Netherlands may order.

4. Prices and payment options
All prices stated in the online shop include the statutory value added tax.
The following payment options are available in the online shop:
 Credit card (Visa & Master/MaestroCard), giropay, Sofort-Online-Überweisung international, PayPal.

- Credit card
Payment can be made by credit card (VISA / MASTERCARD including MAESTRO). We reserve the right to check the validity of the credit card, the creditworthiness and the correctness of the address data of the customer and to make the acceptance of the order dependent on the check result. The transaction currency is EURO and your card will be charged on the exact day of the order. The invoice text (descriptor) „www.zerresstore.com“ will be displayed on your credit card invoice. In the event of a return, the amount to be refunded will be credited to your credit card account after the return has been checked and processed. The transmission of your payment data is SSL/TLS encrypted.

To increase the security of your credit card payment on the Internet, the 3D-Secure procedure (two-factor authentication „Verified by Visa/Mastercard Identity Check“) is used. By checking two independent security features, it is guaranteed that a payment on the Internet can only be made by you. Depending on the bank, this can be, for example, a fingerprint scan in a banking app or a one-time SMS password

- Giropay
In order to use the giropay payment method, you need a current account activated for online banking via PIN/TAN procedure. In addition, the participation of your bank in the giropay procedure is a prerequisite. 
With the giropay payment method, you make an online transfer in the online banking environment of your credit institution.

- PayPal
In order to use the PayPal payment method, you must have a PayPal account. You can open this account on the PayPal website at www.paypal.de/anmeldung. If you select the PayPal payment method, you will be redirected to your PayPal page. The payment is made directly via your bank or credit card details stored at PayPal without having to re-enter them. Your bank or credit card details are therefore only stored at PayPal and do not have to be sent over the Internet every time you make an online purchase.

- Sofortüberweisung.de
Sofortueberweisung.de is a direct transfer method. It allows you to conveniently make a bank transfer via your online banking account during the order process. As with online banking, you need a PIN and TAN - neither we nor third parties have access to your data thanks to the encryption technology that your bank also uses.

- Online gift voucher
Payment can be made using a Zerres Store online gift voucher. Please enter the voucher code printed on the gift voucher in the payment process. If the value of the basket exceeds the balance of your gift voucher, select an additional payment method to pay the remaining amount. Only one gift voucher can be redeemed per order.
In the event of a return, any amounts on the gift voucher will be refunded. Therefore, please ensure that you store your gift voucher for a sufficiently long period. In the event of a return, we will proceed as follows:
If it is a partial return, your gift voucher will be debited as far as possible and you will receive your credit via the second selected payment method. If the credit exceeds the amount of the second selected payment method, a partial credit will be made to the gift voucher. In the case of a full return, the amount will be refunded in the same way as the payment method.

5. Restriction of payment methods and late payment
We reserve the right, depending on the result of the verification of your data (identity and creditworthiness check), to allow only certain payment methods.

You also have the option of having the purchased goods delivered to the Zerres Factory Store, Regioparkring 1, 41199 Mönchengladbach.

We will notify you as soon as you can collect the goods there. The goods can then be collected within 14 days from the date of receipt of the relevant email notification.
If you do not wish to collect the goods yourself, you can nominate a person to collect them from us via a link in your collection notification email.

If the goods are not collected within 14 days of receipt of the notification, we have the option to withdraw from the contract. If we exercise this right, any consideration already paid will be refunded to you without delay.

7. 8. Warranty
The Consumer shall be entitled to warranty for defects of the purchased goods in accordance with the statutory provisions of §§ 437 et seq. BGB. In particular, the Customer may demand subsequent performance (new delivery or remedy of defects). Zerres Retail GmbH & Co. KG shall, however, be entitled to refer the Customer to a new delivery if the remedy of defects would involve unreasonable expenditure. The warranty claims shall expire two years after delivery of the goods. The customer should assert his warranty claims by stating the order number, his name and address and briefly stating the reasons, without this being obligatory. The Customer shall, at the request of Zerres Retail GmbH & Co. KG, send the defective goods to Zerres Retail GmbH & Co. KG for inspection at the expense and risk of Zerres Retail GmbH & Co. KG, without this limiting the warranty rights.

Your personal data required for the respective order or reservation will be collected, processed, used and stored by us in accordance with the respective statutory data protection provisions for the purpose of executing the contract or the reservation and for the protection of legitimate interests. For the purpose of credit assessment, we may obtain information from credit agencies in accordance with the data protection regulations and pass on to them personal data relating to the supply contract. If this gives rise to doubts about your creditworthiness, we are entitled to refuse to conclude a contract.

10. ALTERNATIVE CONTRIBUTION GEMÄSS ART. 14 ABS. 1 ODR-Regulation AND § 36 VSBG
Under applicable law, we are obliged to inform consumers of the existence of the European Online Dispute Resolution platform, which can be used for the resolution of disputes without the need to go to court. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
