Loyalty card conditions

The following conditions of participation apply to our ZERRES FACTORY STORE CARD:

GENERAL REQUIREMENTS
The ZERRES FACTORY STORE CARD is a free customer card of ZERRES RETAIL GmbH & Co. KG and is only issued to persons of full age.
The ZERRES FACTORY STORE CARD entitles the holder to participate in the customer card programme „ZERRES FACTORY STORE CARD“ of ZERRES RETAIL GmbH & Co. KG. The ZERRES FACTORY STORE CARD is valid exclusively in the ZERRES FACTORY STORE, Regioparkring 1, 41199 Mönchengladbach and in the webshop of
ZERRES RETAIL GmbH & Co. KG.

PARTICIPATION REQUIREMENT
Participants (hereinafter referred to as „cardholders“) can be any natural person who has reached the age of 18. Participation is free of charge. The prerequisite for participation is the provision of the name, full address and date of birth. ZERRES RETAIL GmbH & Co. KG reserves the right to refuse the participation of persons for good cause. Furthermore, ZERRES RETAIL GmbH & Co. KG reserves the right to exclude the cardholder from further participation in the customer card programme in the event of misuse.

CANCELLATION
The cardholder may cancel participation in the customer card programme at any time.
ZERRES RETAIL GmbH & Co. KG is entitled to terminate participation in the customer card programme at any time by giving one month's notice to the cardholder. In the event of termination by ZERRES RETAIL GmbH & Co. KG for good cause this may also be effected without observing a period of notice.

Contents of Service
The ZERRES FACTORY STORE CARD entitles the holder to a 3% immediate discount on the respective purchase when presented in the ZERRES FACTORY STORE as well as in the web shop of ZERRES RETAIL GmbH & Co. KG. No discount is granted on gift cards or online gift vouchers. A subsequent refund of the discount
on purchases already made is not possible. The 3% instant discount is not granted on goods that have already been reduced. The ZERRES FACTORY STORE CARD is non-transferable. It may only be used by the cardholder.

&Amendment of conditions – setting up the customer card programme
ZERRES RETAIL GmbH & Co. KG reserves the right to amend these Terms and Conditions of Participation and to restrict, amend, delete or expand services from the Customer Card Programme or to include new services in the Customer Card Programme. Changes are permitted in particular, but not exclusively, if this is necessary in the interest of simpler processing and to prevent abuse. Any changes will be notified to the Cardholders by e-mail, insofar as they have provided an e-mail address, and independently thereof by posting in the offices of the ZERRES FACTORY STORE and on the Internet at www.zerresstore.com/Kundenkartenbedingungen. ZERRES RETAIL GmbH & Co. KG also reserves the right to discontinue the customer card programme in its entirety, subject to a reasonable period of notice, or, if there is good cause, to discontinue the customer card programme without such notice.

The claims already accrued at the time of the change in services or the discontinuation of the customer card programme or the changes to the conditions of participation remain unaffected by this. The amendment or addition to the Conditions of Participation shall be deemed to have been approved unless the Cardholder terminates the Agreement within one month after notification of the amendment or the Cardholder continues to use the Customer Card after notification of the amendment.

DEMAND OF LIABILITY
The Cardholder's claims for damages shall be excluded. Excluded from this are claims of the Cardholder based on injury to life, limb, health or based on the violation of essential contractual obligations (so-called cardinal obligations) as well as liability for other damages resulting from an intentional or grossly negligent breach of duty on the part of ZERRES RETAIL GmbH & Co. KG, its legal representatives or its vicarious agents.

In the event of a breach of material contractual obligations, i.e. obligations the fulfilment of which is necessary to achieve the objective of the contract,
ZERRES RETAIL GMBH & CO. KG shall only be liable for compensation of the foreseeable damage typical for the contract if this was caused by simple negligence, unless it is a matter of claims for damages by the cardholder arising from injury to life, limb or health.

DATA PROCESSING FOR THE CUSTOMER CARD PROGRAMME
Participation in the Customer Card Programme requires the Cardholder to provide his/her name and full address and date of birth.

The Cardholder warrants the accuracy of the information provided in his/her Customer Card application. The cardholder undertakes to notify
ZERRES RETAIL GmbH & Co. KG – of any changes as soon as possible in writing – so that participation in the customer card programme can take place in full even after the occurrence of changes.

INFORMATION ON CURRENT TERMS AND CONDITIONS
The constantly updated benefits available to Cardholders and the current terms and conditions can be viewed in the ZERRES FACTORY STORE and are available in printed form in the ZERRES FACTORY STORE upon request. The currently valid Terms and Conditions are also available on the Internet at: www.zerresstore.com/Kundenkartenbedingungen

APPLICABLE LAW
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

DISPUTE AND CONSUMER ARBITRATION BOARD
ZERRES RETAIL GmbH & Co. KG is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

JURISDICTION
As far as a jurisdiction agreement is legally permissible, the jurisdiction for all disputes arising from contractual relationships between
ZERRES RETAIL GmbH & Co. KG and the cardholder shall be Mönchengladbach – Rheydt.
